This section governs your use of the sunnypilot websites (“Sites”) and related internet-based services we operate (“Services”). The Information and any trade secrets or know-how it contains remain the exclusive property of SUNNYPILOT LLC. SUNNYPILOT LLC grants no license to you pursuant to any copyright, patent, trademark, or trade secret rights.

The following Terms of Service describe the terms and conditions on which we offer you access to our Sites and Services, defined below. Capitalized terms used in these Terms shall have the meanings set forth below under “Definitions” or in the text of these Terms.
Our offer to allow you to access the Sites and Services is conditioned on your agreement to all of the terms and conditions contained in these Terms, including your compliance with the policies and terms linked to from this Agreement, such as our Privacy Policy. If you do not agree to be bound by these Terms in their entirety, you must cease accessing or otherwise using the Sites and Services in any way.
Your use of any of the Sites or Services constitutes your agreement to these Terms. We may amend these Terms at any time in our sole discretion, effective upon posting the amended Terms at this URL where the prior version of these Terms was posted or by communicating these changes through any written contact method we have established with you. Your use of the Sites or Services following the date on which such amended Terms are published will constitute consent to such amendments. However, if you cease using the Sites or Services upon such publication, your relationship with us will continue to be controlled by the previous version of these Terms.
You agree that you will periodically check this page for updates to these Terms and read the messages we send you to inform you of any changes.
“Company,” “sunnypilot,” or “We” shall mean SUNNYPILOT LLC and/or any of its affiliates, individually and collectively, doing business as sunnypilot or otherwise.
“Company Parties” shall mean the Company, its affiliates and subsidiaries, and any of their directors, employees, agents, attorneys, third-party content providers, distributors, licensees or licensors.
“Service” or “Services” shall mean any of the internet-based or other services offered by the Company, including, but not limited to, those described in this Agreement, whether through a website owned or controlled by the Company, through a social networking system, a mobile application, on your cellphone or otherwise.
“Content” shall mean each and every item of content or other material uploaded by a user to the Sites or otherwise integrated into the Sites by a user.
You may use our Sites only if you can form a binding contract with sunnypilot in compliance with this Agreement. To become a Registered User, you must be at least eighteen (18) years old and must not have had a previous account terminated or access revoked by sunnypilot. Providing false or misleading information when creating an account is a violation of these Terms.
You are solely responsible for your use of the Sites, any Content you submit, your interactions with other users, and any consequences thereof. Content you submit may be viewable by other users and third parties. You should only submit Content you are comfortable sharing and that does not violate any third-party rights.
sunnypilot reserves the right, but is not obligated, to remove any Content in its sole discretion. sunnypilot has no obligation to monitor disputes between users and assumes no liability for user interactions.
You agree not to impersonate others, submit false information, misuse accounts, modify or reverse engineer the software, interfere with the Sites’ operation, remove proprietary notices, submit misleading sponsored content, violate network security, distribute malware, spam users, scrape data, bypass safeguards, or engage in unlawful or abusive behavior.
You are responsible for any consequences arising from violations, including indemnifying the Company for resulting damages.
You retain ownership of Content you submit. However, by submitting Content, you grant sunnypilot a royalty-free, transferable, sublicensable, perpetual, worldwide license to use, reproduce, modify, distribute, display, and create derivative works from that Content for both commercial and non-commercial purposes.
All rights to the Sites, excluding user Content, remain the exclusive property of sunnypilot. Subject to these Terms, sunnypilot grants you a limited, non-exclusive, non-transferable, revocable license to use the Sites for personal, non-commercial use only.
By using the Sites, you consent to the collection, use, and processing of your information in accordance with our Privacy Policy, including transfer to and processing in the United States.
The Sites may contain advertisements and links to third-party services. sunnypilot does not endorse or assume responsibility for third-party content or services, and you access them at your own risk.
sunnypilot complies with the Digital Millennium Copyright Act (DMCA). If you believe Content infringes your copyright, you may submit a compliant DMCA notice. Misrepresentation may result in liability.
You may stop using the Sites at any time. sunnypilot may suspend or terminate access without notice for violations of these Terms. Certain provisions will survive termination, including ownership, disclaimers, and limitations of liability.
You agree to defend, indemnify, and hold harmless sunnypilot and its affiliates from any claims arising from your use of the Sites, violation of these Terms, infringement of third-party rights, or unlawful conduct.
The Sites are provided “as is” and “as available.” sunnypilot disclaims all warranties to the fullest extent permitted by law. sunnypilot shall not be liable for indirect, incidental, consequential, or punitive damages. Total liability shall not exceed the greater of $50 USD or the amount paid by you to use the Sites.
These Terms are governed by the laws of the State of Virginia. Disputes shall be resolved through binding arbitration unless otherwise required by law. Certain disputes may be resolved exclusively in Virginia courts.
Any claim must be brought within one (1) year of accrual or be forever barred.
We may update these Terms from time to time. Continued use of the Sites constitutes acceptance of the updated Terms.
The Sites are based in the United States. Users accessing from other countries do so at their own risk and are responsible for compliance with local laws.
CONDITION OF USE
THIS SOFTWARE IS LICENSED, NOT SOLD. BY DOWNLOADING, INSTALLING, COPYING, OR USING THE SUNNYPILOT SOFTWARE, YOU AGREE TO BE BOUND BY THESE TERMS.
IF YOU DO NOT AGREE TO THESE TERMS, YOU HAVE NO RIGHT TO ACCESS OR USE THE SOFTWARE. YOU MUST IMMEDIATELY STOP USING THE SOFTWARE, UNINSTALL IT FROM ALL DEVICES, AND DELETE ALL COPIES IN YOUR POSSESSION. CONTINUED USE OF THE SOFTWARE CONSTITUTES YOUR EXPRESS AGREEMENT TO THESE TERMS.

Please read these Terms of Service (“Terms”) carefully before using sunnypilot which is software developed by SUNNYPILOT LLC, a Limited Liability Company organized under the laws of Virginia ("sunnypilot," “us,” “we,” or “our”). sunnypilot is a software forked from openpilot which is open-sourced software developed by Comma.ai, Inc., a corporation organized under the laws of Delaware (“comma”). sunnypilot builds upon the foundation of openpilot by incorporating additional features and improvements. openpilot can be found on https://github.com/commaai/openpilot
Before using and by accessing sunnypilot, you indicate that you have read, understood, and agree to these Terms. These Terms apply to all users and others who access or use sunnypilot. If others use sunnypilot through your user account or vehicle, you are responsible to ensure that they only use sunnypilot when it is safe to do so, and in compliance with these Terms and with applicable law. If you disagree with any part of the Terms, you should not access or use sunnypilot.
You agree that sunnypilot may contact you by email or telephone in connection with sunnypilot or for other business purposes. You may opt out of receiving email messages at any time by contacting us at support@sunnypilot.ai.
We collect, use, and share information from and about you and your vehicle in connection with sunnypilot. You consent to sunnypilot accessing the systems associated with sunnypilot, without additional notice or consent, for the purposes of providing sunnypilot, data collection, software updates, safety and cybersecurity, suspension or removal of your account, and as disclosed in the Privacy Policy.
sunnypilot performs the functions of Adaptive Cruise Control (ACC) and Lane Keeping Assist System (LKAS) designed for use in compatible motor vehicles. While using sunnypilot, it is your responsibility to obey all laws, traffic rules, and traffic regulations governing your vehicle and its operation. Access to and use of sunnypilot is at your own risk and responsibility, and sunnypilot should be accessed and/or used only when you can do so safely.
sunnypilot does not make your vehicle “autonomous” or capable of operation without the active monitoring of a licensed driver. It is designed to assist a licensed driver. A licensed driver must pay attention to the road, remain aware of navigation at all times, and be prepared to take immediate action. Failure to do so can cause damage, injury, or death.
sunnypilot is compatible only with particular makes and models of vehicles. For a complete list of currently supported vehicles, visit https://comma.ai. sunnypilot will not function properly when installed in an incompatible vehicle. sunnypilot is compatible only within the geographical boundaries of the United States of America.
SUNNYPILOT LLC develops software only. We do not manufacture, sell, distribute, or support any hardware devices (including but not limited to "panda" dongles, "comma" devices, or cabling). You acknowledge that you are solely responsible for obtaining compatible hardware and installing the software at your own risk. sunnypilot assumes no liability for damage to your vehicle, hardware, or person resulting from the installation or physical integration of this software with your vehicle's electronic systems.
To the maximum extent allowable by law, you agree to defend, indemnify and hold harmless sunnypilot, and its employees, partners, suppliers, contractors, investors, agents, officers, directors, and affiliates, from and against any and all claims, damages, causes of action, penalties, interest, demands, obligations, losses, liabilities, costs or debt, additional taxes, and expenses (including but not limited to attorneys’ fees), resulting from or arising out of (i) your use and access of, or inability to use or access, sunnypilot, (ii) your breach of these Terms, (iii) the inaccuracy of any information, representation or warranty made by you, (iv) activities of anyone other than you in connection with sunnypilot conducted through your comma or other compatible device or account, (v) any other of your activities under or in connection with these Terms or sunnypilot.
In no event shall sunnypilot, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use of the Software; or (ii) any conduct or content of any third party on the Software whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
sunnypilot provides sunnypilot without representations, conditions, or warranties of any kind. sunnypilot is provided on an “AS IS” and “AS AVAILABLE” basis, including with all faults and errors as may occur. To the extent permitted by law and unless prohibited by law, sunnypilot on behalf of itself and all persons and parties acting by, through, or for sunnypilot, explicitly disclaims all warranties or conditions, express, implied, or collateral, including any implied warranties of merchantability, satisfactory quality, and fitness for a particular purpose in respect of sunnypilot.
To the extent permitted by law, sunnypilot does not warrant the operation, performance, or availability of sunnypilot under all conditions. sunnypilot is not responsible for any failures caused by server errors, misdirected or redirected transmissions, failed internet connections, interruptions or failures in the transmission of data, any computer virus, or any acts or omissions of third parties that damage the network or impair wireless service.
We undertake reasonable measures to preserve and secure information collected through our sunnypilot. However, no data collection, transmission or storage system is 100% secure, and there is always a risk that your information may be intercepted without our consent. In using sunnypilot, you acknowledge that sunnypilot is not responsible for intercepted information, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
By providing sunnypilot, sunnypilot does not transfer or license its intellectual property or grant rights in its brand names, nor does sunnypilot make representations with respect to third-party intellectual property rights.
We are not obligated to provide any maintenance or support for sunnypilot, technical or otherwise. If we voluntarily provide any maintenance or support for sunnypilot, we may stop any such maintenance, support, or services at any time in our sole discretion.
In no event shall sunnypilot, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable if you choose to modify the software.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 15 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Software after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Software.
sunnypilot is a "fork" of open source software compatible with hardware and services provided by Comma.ai, Inc., a corporation organized under the laws of Delaware (“comma”). By using sunnypilot, you acknowledge that certain features, including but not limited to "comma Connect," cloud logging, and remote access, rely on servers and infrastructure owned and operated by comma.
SUNNYPILOT LLC is an independent entity and is not affiliated with, endorsed by, or sponsored by comma. Your use of comma's services is subject to comma's own Terms & Conditions and Privacy Policy (https://comma.ai/terms).
You acknowledge that comma reserves the right to restrict or ban devices running modified software (forks) from accessing comma services, including but not limited to "comma Connect", if they violate comma's Terms & Conditions, Privacy Policy, and comma's safety policies. SUNNYPILOT IS NOT LIABLE IF YOUR DEVICE IS BANNED FROM COMMA SERVICES OR IF YOUR ACCESS TO COMMA CONNECT IS TERMINATED DUE TO YOUR USE OF THIS SOFTWARE. You assume all risks associated with using non-stock software on your device.

This Privacy Policy explains our policies and practices regarding how data may be collected, stored, used, transferred, shared or sold by SUNNYPILOT LLC for sunnypilot. SUNNYPILOT (“sunnypilot,” “we,” or “us”) is a Limited Liability Company organized under the laws of the state of Virginia. This Privacy Policy applies to sunnypilot, which is software developed by sunnypilot.
By using sunnypilot, you agree that sunnypilot owns all data that is conveyed to us by use of the service and that we may use it any way, and alter it in any way, at our sole discretion. You grant sunnypilot a non-exclusive, worldwide, royalty-free license to collect, store, process, analyze, modify, and use data generated through the Services for operation, security, improvement, research, and development purposes, including creation of aggregated or anonymized datasets. We may collect your personal information, such as your name, phone number, and email address, as well as other information you provide to us. Personally-identifiable information or any information or combination of information that both relates to you and can be used to identify you (“Personal Information”) may be collected when you consent to that collection by providing such information on a voluntary basis. sunnypilot connects to a vehicle’s CAN bus, and it receives and generates data about the vehicle’s use, operation, and performance, including but not limited to geolocation of the vehicle, trip durations and routes, parking locations of your vehicle, braking, and acceleration. sunnypilot uses driver monitoring software that watches the driver and tracks his or her head and eyes, ensuring he or she is monitoring the driving environment. We may collect video from the driver monitoring feed only if you opt in through the settings of sunnypilot. You should notify those who use or occupy your vehicle while sunnypilot is used.
We use data collected through sunnypilot to complete transactions with you; to provide, analyze, and improve the performance and security of sunnypilot; to improve or modify other existing products and services; and/or to develop new products and services. We may share personal information with service providers and business partners, or with other third parties. We may also share information collected through sunnypilot to comply with a legal obligation, when we believe in good faith that the law requires it, in response to a lawful request by government authorities, or in other circumstances in which sharing such information may be required by law. Unless you have opted out of receiving materials or notifications from us, we may periodically use your email address to send you such materials and notifications. If you want to stop receiving such materials and notifications from us, you can contact us at the information below to alert us to your preference. In addition, you can opt out of, or unsubscribe from, receipt of such emails at any time by following the instructions contained in those emails.
You have options regarding certain information provided for use with sunnypilot, as described in this policy. You may decline to share the driver monitoring camera recording with us by keeping the "Upload Driver Camera" setting toggled OFF. Your privacy profile settings are accessible via the settings button in sunnypilot. You can review and update your personal information by contacting us at the email address provided below.
We will occasionally update this Privacy Policy to reflect changes in our practices and Software. When we post changes to this Privacy Policy, we will revise the “Last Updated” date at the top of this Privacy Policy. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by sending an email to the email address you most recently provided us, unless we do not have such an email address, and/or by prominently posting notice of the changes on our website.
